Pot Matters: Why Trump Can’t Stop Legalization


The legalisation of marijuana has been on the rise in recent years, but are people right in fearing that the Trump administration will end this?




There has been a lot of speculation since the surprise victory of President-Elect Trump, in particular, who is going to be his choice of Attorney General, in the running is legalization opponent Rudolph Giuliani.


Articles from CBS News and the Wwashington Post have addressed how the Obama Administration have not chosen not to interfere with the matter of marijuana legalisiation, and how Trumps choice of A.G could totally change this.



Anyone particularly worried about whether Trump is going to try and fight the marijuana culture, is that in the eight states and Washington, D.C. that have chose to legalise, there is one simple fact: the federal government can’t force a state to arrest anyone, under any circumstance. Meaning it is up to the individual state laws as to whether they deem marijuana use illegal or not.

It is true, however, that the Department of Justice can enforce the federal Controlled Substances Act (CSA) and take action against the marijuana industry in the states where it is legal. The Trump Administration can also take legal action against states to stop them aiding and abetting violations of the CSA through enforcement of state laws.

There is a chance the Trump Administration could make it illegal to be involved in the producing of marijuana products, but this would come as a shocking u-turn on the law already in place and would raise serious questions about u-turns in general for the Republican party.

Even if the Trump Administration went ahead and did this, it would still be down to state police to decide to arrest and prosecute or not. If you live in a legal state, here's hoping that the police are happy with the current laws and would carry on enforcing them, rather than go along with Trump's wishes.

A federal ban on all marijuana products will only highlight how successful the selling of banned substances are during periods of prohibition. No matter what the new A.G feels about marijuana, there always has and always be supply and demand for it. It is up to the federal government as to whether they want to work with the process, or against it.
